NDIS Lawyer

Your Next Step

Whether your NDIS access request has been rejected or your plan doesn’t reflect the support you need, understanding your review options is the first step. Contact NLS Law to discuss your circumstances.

The sooner you act on an NDIS decision, the more options you have.

A decision from the National Disability Insurance Agency (NDIA) can have a significant impact on your life, whether it’s a rejected access request, a plan that doesn’t reflect your support needs, or a change to your funding. If you disagree with a decision, you’re entitled to an NDIS review, but strict time limits apply, so it’s worth understanding your options as early as possible.

The first step is usually to request an internal review of the decision by the NDIA. Depending on what’s being reconsidered, this is sometimes referred to as an NDIS review or an NDIS plan review. A plan review generally looks at whether your current supports and funding still reflect your needs, while a broader NDIS review can cover access decisions, plan management arrangements, and other decisions the NDIA has made about your case.

If the internal review doesn’t resolve the issue, you can appeal the NDIS decision to the Administrative Review Tribunal (ART), formerly known as the AAT, for an independent review. Our NDIS lawyers can advise you on both stages of this process, from the initial internal review through to preparing an appeal, including what evidence is likely to support your case.

We assist with a wide range of NDIS matters, including access request reviews, plan reassessments, disputes over funding levels and support items, and decisions relating to plan management. We can also help you prepare for a functional capacity assessment or respond to a request for further information from the NDIA, so you’re not navigating the process alone.

If your matter proceeds to the Administrative Review Tribunal, we can represent you at conferences and hearings, help you understand what to expect, and work alongside any support people, advocates or medical professionals involved in your case.

Based in Newcastle with a Sydney office, we act for clients with NDIS matters across NSW. NDIS reviews and appeals can be stressful and confusing, particularly when you’re already managing a disability or supporting a family member. We aim to explain your options clearly, without unnecessary legal jargon, so you can make informed decisions about what to do next.

If you’ve received an NDIS decision you want to challenge, you’re partway through an NDIS review, or you’re unsure what your options are, contact NLS Law to discuss your circumstances with our team.
