Understanding Parenting Plans

A parenting plan is a voluntary agreement that encompasses the daily duties of each parent, the practical aspects of a child’s daily routine, and the method by which the parents collaborate on significant and long term decisions regarding their children. Parenting plans are flexible agreements which can be modified as needed, provided that both parents agree.

Under the Family Law Act 1975, a parenting plan must be made and signed by both parents of the child. Under the Family Law Act 1975, a parenting plan must be in writing, signed and dated by both parties. It must also be free from any coercion, threats or duress.

A parenting plan can deal with any of the following issues:

  • Allocation of parental responsibility 
  • Where the child should live
  • What time the child spends with both parents
  • How the child will communicate with the parent they do not live with 
  • Parenting arrangements for holidays and special occasions 
  • What process can be used to change the parenting plan or resolve disagreements 
  • Any aspect of the care, welfare or development of a child
  • Child support
